Welcome to Public Eye. By using our platform and services, you (hereinafter referred to as User) agree to the following terms and conditions. Please read them carefully.

1. Acceptance of Terms

By accessing or using the services provided by Public Eye (hereinafter referred to as Service Provider), you acknowledge and agree to be legally bound by these Terms of Service (hereinafter referred to as Terms). If you do not agree with any part of these Terms, you must refrain from using our services immediately.

2. Services Provided

The Service Provider offers commercial information consulting services, including but not limited to:

  • Providing commercial information about companies or      individuals, including Company Registration Verification, Legal Compliance      Review, Company Business Background, Legal Disputes, and Real Controller      Background.

  • Performing risk assessments and company verification to assist      in making informed business decisions.

  • Delivering detailed reports based on collected information and      analysis.

The scope of the services will be determined by the Service Provider based on the User’s request, which has to be for purely commercial and legal use. The Service Provider reserves the right to refuse any request that is deemed illegal, unethical, or in violation of international or local laws.

3. User Responsibilities

The User agrees to:

  • Provide accurate, complete, and truthful information when      making service requests.

  • Use the information provided by the Service Provider for commercial      and lawful purposes only and in compliance with the laws of their own      jurisdiction and that of the Service Provider.

  • Acknowledge that the Service Provider is not responsible for decisions      made based on the information provided.

  • Ensure that the use of the Service does not contravene any      local or international legal restrictions, particularly regarding judicial      or governmental investigations.

The User must submit authentic personal and business information. Any submission of falsified data will lead to immediate termination of services, and the User assumes full legal responsibility for any legal implications that arise from such behavior.

4. Fees and Payment

  • Service Fee: The User agrees to pay      the specified fees for the services they request, as displayed on the      Service Provider’s platform.

  • Payment Method: Payments must be      made via the available payment options listed on the website (e.g.,      PayPal, Stripe, etc.).

  • Refunds: All fees paid are      non-refundable, except in the case of an error or failure in service      delivery directly attributable to the Service Provider. Any exceptions to      this policy must be agreed upon by the Service Provider in writing.

The Service Provider reserves the right to adjust the service fees at any time, but no changes will affect services already paid for unless otherwise specified in the updated Terms.

5. Confidentiality

Both the User and the Service Provider agree to maintain the confidentiality of any proprietary, sensitive, or personally identifiable information (Confidential Information) shared during the provision of services. The Service Provider will take all reasonable measures to protect such information, and the User agrees not to disclose or misuse the information for any unlawful purposes.

However, in the event of any legal investigation or regulatory request, the Service Provider reserves the right to disclose any information required by law. The User will be informed of such disclosure unless legally prohibited.

6. Client Verification

To ensure compliance with international legal frameworks, the Service Provider requires the User to provide necessary identification details for verification purposes. This is to prevent unlawful activities, including but not limited to money laundering, fraud, or providing services to sanctioned entities or individuals and governmental investigations. The User’s failure to comply with these requirements may result in the termination of services without liability on the part of the Service Provider.

7. Disclaimer of Warranties

The services provided by the Service Provider are based on accurate and publicly available information to the best of the Service Provider’s knowledge. The Service Provider is committed to providing information that is as accurate, complete, and timely as possible, relying on reliable, lawful sources and applying rigorous analysis methods. However, due to the dynamic nature of the information industry and external factors beyond the Service Provider's control, absolute accuracy or completeness cannot be guaranteed for all information.

8. Limitation of Liability

In no event shall the Service Provider be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use the services, even if the Service Provider has been advised of the possibility of such damages.

The Service Provider’s total liability shall not exceed the amount paid by the User for the specific services.

9. Compliance with International Laws

The User acknowledges that their use of the services must comply with applicable international laws, including but not limited to anti-money laundering (AML) regulations, privacy laws, and data protection standards. The User agrees to indemnify and hold harmless the Service Provider from any legal actions or fines resulting from unlawful use of the services.

The Service Provider will not knowingly provide services to entities or individuals listed under any applicable sanctions program, and reserves the right to terminate such services without prior notice.

10. Termination

The Service Provider reserves the right to suspend or terminate access to services at any time, without notice, for conduct that violates these Terms or is harmful to the Service Provider, other Users, or violates international or local law. Termination may also occur if the User is found to have provided false or incomplete information or if their activities raise legal or ethical concerns.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms will be resolved in the competent courts of Hong Kong.

12. Changes to Terms

The Service Provider reserves the right to modify these Terms at any time. Users will be notified of significant changes, and continued use of the services after such changes will constitute acceptance of the updated Terms.
